Well last year I went to a payroll cash advance place took out the max 245 and had to pay 300 I wrote a check and I would go pay two weeks later or they send it to my bank I was doing it for two months but the last time I lost my job and my funds were negative in my account so they sent the check to my bank it got return they did it a few more times I got overdraft fees then my account was closed by the bank. A year later I get a call saying im a lawyer for so and so I owe 700 now but they will settle for 350 they said if I dont I could get two felonies for checked fraud now I just read no criminal charges can be filed just civil suit s to get the money back. Now is this “lawyer” scamming me into paying and like an idiot I gave my card number cause i was scared of jail time. Im just curious I am gonna payback when my money right just shit happened couldnt pay then. I want to know if im getting fooled by an attempt to collect

I’m not sure exactly what you are asking.

If a lawyer has contacted you, and has told you that if you do not pay them $ 350 to settle the case, they will turn it into the criminal authorities, you need to get the lawyer’s name and bar number, and report them to the disciplinary authorities of your state, (or the state in which they are admitted). It is a serious ethical violation to use the threat of criminal prosecution to settle a civil matter.

You are correct that this is a civil matter. There are not criminal charges that I can think of that can be filed based on the fact pattern that you gave above.

The first thing to do is to get the name of the “lawyer” and ask for the address and the state into which he is admitted to practice law. Then, do a little research and determine if he is actually licensed in that state. Its not hard to do. The internet does wonders in this regard.

If it turns out he is not admitted to practice, you can forward that information to your local authorities, as he is in fact violating criminal law by claiming to be a lawyer when he is not. If he is licensed to practice, then see above. Report him for violating the ethics code.

If you gave him your card number, I would put a stop on the card so they cannot charge the card. Then, you can negotiate if you want for a settlement of the amount due. Make sure you ONLY negotiate in writing, and make sure that you keep copies of correspondence both from you and to you. If you get over your heard, contact your local or state bar association for a referral to an attorney licensed in your state.

Johnson Comments on the Arrest of Happy Gilmore Villain

Best known for his roll in Happy Gilmore, actor Christopher McDonald was pulled over last week and charged with drunk driving. DUI attorney Dane Johnson says that the charges may not be as serious as they sound.

The arrest came early Wednesday morning when McDonald was pulled over by state troopers according to KHOU News (10.16.2013). There was no crash and no one was hurt.

McDonald played as Shooter McGavin, the villain of the 1996 Adam Sandler comedy. In it, he tried to drive aspiring golf star Happy Gilmore (Sandler) out of the sport, resorting to cheating and even violence. Johnson says that his alleged real-life lawbreaking is far less extreme.

DUI laws are stricter than most people think, said Johnson, the founder of Johnson, Johnson & Baer law firm, who works extensively on drunk driving cases. The result is that normal, everyday people get pulled over.

According to KHOU, the trooper who arrested McDonald said that he began to suspect the actor had been drinking only after pulling him over. He asked McDonald to perform a breathalyzer test and the result was a 0.15% blood alcohol content. The legal limit in all states is 0.08%.

Johnson says breaking the legal limit is deceptively easy.

0.08% is what you hit after having one, or at most two drinks, Johnson said. Most people feel safe to drive after having a single drink.

Blood alcohol content can also remain elevated long after drinking, Johnson says.

If you have wine with dinner, and then hours later you drive to the store, chances are you are over the legal limit, he said.

McDonald was put in jail with a $ 1,000 bond reported KHOU.
