North Charleston, SC (PRWEB) December 03, 2012

South Carolina car accident lawyer Ken Harrell today urged young drivers to use caution behind the wheel after a new survey by the AAA Foundation for Traffic Safety found that drivers between the ages of 16 and 24 are much more likely to fall asleep while driving than are older drivers.

Fatigued driving has long been a serious, yet under-reported, danger on the nations roadways. When you combine young, inexperienced drivers with the inherent dangers associated with driving while drowsy, you drastically increase the likelihood of a serious collision, said Harrell, managing partner of Joye Law Firm.

The AAA study found that 1 in 7 young drivers admitted to nodding off behind the wheel in the past year compared to 1 in 10 of all licensed drivers.

As the holiday season approaches, thousands of young drivers will be driving home from college for winter break, many of whom will be coming off of a week-long session of late-night cramming for final exams. Unfortunately, after decades of representing crash victims, I know what can happen when a motorist falls asleep behind the wheel. I urge young drivers to get plenty of sleep after finals before they head home, Harrell said.

Other young drivers also face an increased risk of driving while fatigued this holiday season, with many teenagers and young adults taking long road trips to visit friends and family after working long hours or while on military leave, he said.

Although the AAA study highlighted the propensity of young drivers to drive while drowsy, drivers of all ages should be aware of the signs associated with fatigued driving as we head into the holiday travel season, Harrell said. Most people admit to having driven while drowsy at some point in their life, yet people frequently miss the signs that they are too tired to be behind the wheel.

In fact, a National Sleep Foundation (NSF) report indicates that 41 percent of all drivers said they have fallen asleep while driving at some point in their lives.

According to the NSF, the following are signs that you may be about to nod off behind the wheel:

Atlanta, GA (PRWEB) December 15, 2012

Atlanta car accident lawyer Bruce Millar said today that new federal statistics showing a rise in distracted driving deaths should be a wake-up call for Georgia motorists especially the states younger drivers.

The National Highway Traffic Safety Administration (NHTSA) released figures this week indicating that highway deaths fell to 32,367 in 2011, the lowest level since 1949 and a 1.9 percent decrease from 2010. Georgia reflected the national trend. The states number of fatal car crashes declined by 1.9 percent as well, going from 1,247 in 2010 to 1,223 in 2011.

However, according to the NHTSA, distracted driving-related fatalities actually increased by 1.9 percent in 2011, rising to 3,331 fatal car crashes compared to 3,267 in 2010.

This indicates the need for a strong campaign to combat distracted driving, said Millar of Millar & Mixon, LLC, whose Atlanta personal injury lawyers provide legal help to victims of Georgia distracted driving accidents and their families.

Distracted driving has become the drunk driving of this generation’ in the sense that its a public safety threat that we need to combat just like we began doing many years ago with drinking and driving, Millar said.

The Atlanta car accident lawyer pointed to NHTSA stats showing that alcohol-impaired driving fatalities continued a downward trend in 2011 by falling by 2.5 percent.

Drunk driving is still a major concern, but theres no doubt that spreading awareness, strengthening law enforcement and holding careless drivers accountable through our civil justice system has contributed to a steady decline over the years in drunk driving accidents, Millar said. We need to approach distracted driving with that same urgency and seriousness.

According to the NHTSA, 40 percent of all American teens say they have been in a car when the driver used a cell phone in a way that put people in danger. The 20-under age group has the highest proportion of distracted drivers, the NHTSA says.

We need to instill in this generation that distracted driving can be deadly on our roads, Millar said. And we also need to stress that distracted drivers will be held fully accountable if their careless conduct harms another.

It may not happen overnight, but we are convinced that a truly concerted effort against distracted driving could turn the trend around and save many lives in Georgia and across the country.

Question by Matt B: Am I liable for this fee?
I just recently turned 18, I live in New York City.

Recently I put down a security deposit and a first months rent on a room located in a 1 family residence. 7 days after the payment, I received a copy of a lease agreement from the landlord. After reading it, I did not agree with the terms, and wanted a full refund. I informed the landlord two days after i received the lease agreement that I was no longer interested in the space. He agreed to give me a full refund except a sur-charge (that I was not informed about at all) for an “attorney fee” (which will be deducted out of my refund). He claimed that he paid $ 200 to process the agreement, but i believe it was fabricated by his own hand (due to non-professional text).

Am I liable for this fee.

Also to add:
-There’s no stamp, seal, address, signature, lawyer firm contact or even an attorney’s letter head!
-When I gave him the deposit and rent, he asked when would I like to meet up and to type the lease up with him, print it, and then notarize it (nothing about his attorney correspondence).
-I did not move any objects in and do not possess a key.

Best answer:

Answer by kemperk
depending on what the lease says, I doubt you are libel for
any fees whatever. Go to court and if you win, you will get
back all your fee PLUS 3x for damages in your favor.

Question by Oh what the heck!: Can the bar be held responsible for this?
Two friends of mine were killed in a dui accident, they were at a club/bar drinking they were told to leave because they were drunk, they had been served beer at this establishment for hours, they left “driving” and were killed moments later. Fortunately no one else was injured. Can the bar be held responsible for this?

Best answer:

Answer by dlamb70
the law you are looking for is called the dram shop act. since the bar cut them off, the bar is no longer responsible. had the bar continued to serve them and let them leave on their own, then they would be responsible. the bartender should have asked them if they wanted him to call a taxi just out of human decency.
