MySpace Case Verdict

Terry Bryant Accident & Injury Law has won a significant verdict that hinged, in part, on the introduction of the defendant’s own damaging testimony on the drunk driver’s own MySpace page.

The case revolved around a wreck on Interstate 10 in Houston on June 7, 2009. Sylvia Morales and Luis Perez were stopped along the side of the road after having broken down. The truck’s drive shaft had disengaged and they pulled over, with a portion of the rear side of their vehicle in traffic. The defendant struck their car, wrecking it and severely injuring Morales and Perez.

In Case No. 2010-17655 Sylvia Morales and Luis Perez v. Vonda Barnhart and Erica Browning, the plaintiff’s claimed that the defendant was driving while intoxicated with a blood alcohol content of .28 and that she hit them due to gross negligence. As both sides argued and evidence was presented the case became quite complex. Toxicology reports were presented, expert witnesses took the stand, hospital and medical records were entered into evidence. But the highlight of the case came when the Terry Bryant attorney produced the defendant’s MySpace page showing entries around the time of the wreck that included references to regular alcohol use and abuse such as “made it thru this week only one hangover…YEAH.”

“Ultimately the defendant’s own social media presence contributed to the verdict against her,” Bryant said. The jury found the defendant 95% liable for the collision and the plaintiff’s were awarded $ 608,212.

San Francisco criminal defense attorney Tim Pori says people are careless with information. They don’t seem to realize that the police will comb their cell phones to find incriminating photographs and text messages they can use to support their case. Law enforcement officials are even trained to create a list of possible witnesses from the contacts on the suspect’s phone who they then question to gather information for the prosecution.

“Do not text, blog, email, chirp, tweet, or do anything—and I mean anything—you wouldn’t want your mother or the police department to read or hear,” warns Pori. “Information discovered in your cell phone and Facebook page can be used again you—the law allows it.”

Pori says his clients get nailed for sending text messages that contain their plans to commit crimes or boasts about crimes they have just committed to their knucklehead friends. In fact, he says, every major crime he works on includes cell phone information as evidence.

In addition to capturing information discovered on phones, law enforcement authorities can determine the locations that the device—and presumably owner—has been by tracking the cell phone towers handling the calls and data transfers.

The police use the location data to place defendants at the scene of the crime, or to discover other incriminating information. “The mobile phone company will be able to report your location even if you didn’t talk on it,” said Pori.

In addition to photographs, names, calendar information and notes that people keep on their smart phones, Pori advises people keep all Internet posts completely free of damaging information. Spouses, girlfriends, boyfriends, parents, and even prospective employers all know how to Google someone’s name and telephone number—and many are surprised at what can be found.

“I once Googled a prosecution witness’s phone number, and it took me to a Facebook photo of the guy holding an assault weapon trying to look like Dillinger,” said Pori. “Boy was he surprised when I showed him that photo while he was on the witness stand.”

MISSION VIEJO – Former Vice President Al Gore’s son faced drug charges today in Orange County as his father faced the media while preparing for an international music festival to highlight global warming.

Al Gore III, 24, a Los Angeles resident, was driving a blue Toyota Prius south on the San Diego (5) Freeway about 2:15 a.m. yesterday when a sheriff’s deputy stopped him at the Crown Valley Parkway exit for speeding, said sheriff’s spokesman Jim Amormino.

The deputy smelled marijuana and searched the car, finding less than an ounce of pot, but also the prescription drugs Valium, Xanax, Vicodin, Soma and Adderall, which is used to treat attention deficit disorder.

The Harvard graduate said he did not have a prescription for the drugs and admitted smoking pot shortly before being stopped, Amormino said.

However, authorities did not book him on suspicion of DUI because they decided Gore was not “impaired” by the marijuana, he said.

He was arrested on suspicion of drug possession — and speeding — and booked into jail in Santa Ana on $ 20,000 bail. One of his sisters, reportedly Sarah, posted his bail and he was released about 2 p.m. yesterday.

Appearing on NBC’s “Today” show for a previously scheduled interview, the former vice president — who is one of the organizers of this weekend’s “Live Earth,” a 24-hour, seven-continent concert series to promote the battle against global warming — was asked about the arrest.

“Well, we’re dealing with it as a private family matter,” Gore said, “and we love him very much, and we’re glad that he’s safe, and that he’s getting treatment, and we’re going to leave it as a private matter.”

Possessing less than an ounce of pot is a misdemeanor, but illegal possession of prescription drugs is a felony.

Gore is scheduled to appear in court Aug. 1. Prosecutors have not decided whether to file felony charges against him, said Susan Schroeder of the Orange County District Attorney’s Office.

Orange County offers three drug diversion programs that allow people to undergo treatment instead of going to jail, but participants must meet certain qualifications, she said.

Among the qualifications for the “Drug Court” program operated by the Orange County Superior Court, a participant must have no record of violence, drug trafficking or possession of drugs for sale, said court spokeswoman Carole Levitzky.

It is aimed at people with a second or third offense, and there “has to be a willingness” to go through drug treatment programs, such as attend a 12-step program, she said.

“It’s hard — they get tested frequently,” Levitzky said.

Schroeder said the programs basically require participants to enter guilty pleas. Under a drug diversion program put in place by the Legislature, the defendant enters a guilty plea, but the plea is not entered as a judgment and it is never recorded if the person successfully completes a program.

Under the Proposition 36 program passed by voters, a person pleads guilty and is sentenced to treatment instead of jail, she said.

The son of the former vice president was charged with marijuana possession in Maryland in 2003 after police stopped the car he was driving for not having its headlights on. In February 2004 he entered a substance abuse program as part of a plea agreement.

Gore was ticketed for reckless driving by North Carolina police in August 2000 for allegedly driving 94 mph, and in September 2002, military police arrested him on suspicion of drunk driving near a military base in Virginia.
