<p> Florida Criminal and DUI protection Attorney AnneMarie Rizzo of the law organization Finebloom &#038; Haenel recently argued and won a motion to restrain evidence, which produced DUI fees being dropped against her client.</p>
<p>&#13;</p>
<p>According to the arrest report, the defendant was observed driving the incorrect method against traffic on Sarasota Parkway and came within a couple of feet of hitting the auto of an off-duty policeman. The officer made contact with the motorist and, according to his report, noted that the driver was sluggish to react and exceptionally tired, stumbled for his records, and was unaware of his environments.</p>
<p>&#13;</p>
<p>According to the arrest report, the initial officer then called for a competent DUI deputy to further explore. After a wait of 10 to 15 minutes, the DUI police officer arrived and began his investigation, where he noted, according to his report, the defendants eyes were dilated, his eyelids were droopy, his speech was sluggish and slurred, and he was disoriented. When the DUI representant asked the defendant to exit his automobile, the motorist displayed balance problems and, when he eliminated his hat as requested, there was a laceration to the back of his head. The defendant admitted to taking many sorts of controlled substances. He submitted to field sobriety exams, and was taken to the medical facility for observation, where he agreed to a blood exam. The blood was delivered to the Florida Division of Law Enforcement, and the results came back with a. 197 blood alcohol level. At that time, about a month after the preliminary investigation, an arrest warrant was issued for the motorist.</p>

<p>On July 15, 2001, Virginia Beach Police Officer observed Lee Walker&#8217;s vehicle weaving. When Officer approached Walker, he noticed that Walker &#8220;had a very, very strong odor of alcohol about his person.  As Walker stepped from the automobile, and indicated that he consumed three beers approximately two hours prior to the stop.  Walker failed three field sobriety tests.  As a result of Walker&#8217;s failing the field sobriety tests, Officer placed him under arrest for driving under the influence of alcohol.  Once Walker was in custody, Officer attempted to administer a breathalyzer test. Walker twice blew ineffectively into the machine, and the machine registered &#8220;invalid sample,&#8221; Officer Johnson did not attempt to administer the test again.  Walker was indicted for driving under the influence of alcohol, third or subsequent offense, in violation of Code §§ 18.2-266, 18.2-270, and 18.2-10.  Walker made a motion to dismiss the charge, arguing he was denied the right to and the benefit of breathalyzer results. The Circuit Court of the City of Virginia Beach denied the motion and defendant was subsequently convicted.  Defendant appealed.</p>
<p>Issue:</p>
<p>Whether the trial court erred in denying his motion to dismiss the <a target="_blank" rel="nofollow" href="http://www.dui-attorney-news.com/goto/http://loudounvirginiaduilawyer.com/" target="_blank" rel="nofollow" onclick="javascript:_gaq.push(['_trackPageview', '/outgoing/article_exit_link']);"  title="Loudoun Virginia DUI Laws Harrisonburg Lawyers Attorneys Fauquier">DUI charge</a>?</p>
<p>Discussion:</p>
<p>The Court finds that there are Sufficient evidence to support the trial court&#8217;s finding that defendant deliberately refused to cooperate in giving a <a target="_blank" rel="nofollow" href="http://www.dui-attorney-news.com/goto/http://lynchburgvirginiatrafficlawyer.com/" target="_blank" rel="nofollow" onclick="javascript:_gaq.push(['_trackPageview', '/outgoing/article_exit_link']);"  title="Lynchburg Virginia Traffic Ticket Speeding Ticket Law Reckless Driving Lawyers Attorneys">breath sample</a>.  Defendant, who had two prior DUI convictions, failed three field sobriety tests. Then, in attempting a breathalyzer test, he barely blew into the machine, resulting in the apparatus not being activated. The arresting officer informed defendant that he was not performing the test properly, waited a moment, and let defendant try again, but defendant again failed to blow as instructed. The officer did not try the test again, and defendant did not give a medical reason for not giving a valid breath sample. It was reasonable for the officer to conclude that defendant was not cooperating and that he would continue his non-cooperation if further tests were attempted.</p>
<p>Thus, this court concludes that the denial of the motion to dismiss was not an abuse of discretion.  Finally, the finding of guilt was supported by, inter alia, defendant&#8217;s admission that he had consumed alcohol, his incoherent speech, and the field sobriety tests.</p>

i am in the middle of a custody battle and need to get copies of the opposing parties medical records to have in court. I know I can subpoena them, but I am told by the hospital in question that this is the way they would prefer it be done, And i am am sure the opposing party is sure to contest as the records contain thier multiple attempts at suicide. So i would like to know what book I can find them or what site I can go to get them. Please very detailed if possible. thanks for any help</p>

<p><i>Answer by maxmom56</i><br/>If such a form exists, it would be in a state form book at a law library.  Typically, these are not form motions.  They are substantive motions.</p>
