<p><i>Answer by I can Mash Potato&#8230;.</i><br/>I need to file against my doctor for the problems I have had since I had a surgery performed on me.  I have since had major problems with it and in fact, had to have it removed.  It caused tons of pain, and I am still paying for the damage that has been done.  I cannot afford it, so I&#8217;m filing within a lawsuit that invlves many people.  There are no out of pocket expenses.  SO, the effect?  The effect for me is huge.  I am not able to file my own lawsuit, rather I need to be involved in a Class Action lawsuit (against Ethicon, a Division of Johnson and Johnson), in which I will be compensated for nearly nothing from the attorneys office.  It is extremely frustrating.  </p>
<p>That&#8217;s only one example.</p>
<p>The next is my husbands DUI conviction.  Because we could not afford any out of pocket expenses, we were unable to hire an attorney.  This had a major effect, since he blew a .14 and a decent lawyer would have probably been able to make it a lesser offense.  Or, at least we could have been directed towards a more positive outlook of some sort!</p>
<p>So, those are two SHINING examples of how I was affected.</p>

			<content:encoded><![CDATA[<p><strong>Dwi/dui Penalties are Harsher Than You Think!</strong></p>
<p>The following is an all too familiar scenario in Virginia:</p>
<p>You are returning home after attending a warm send-off party for one of your colleagues. Many close friends and associates had gathered and you were enjoying every moment of the evening.</p>
<p>At the beginning of the party, you were going slowly since you knew you had to drive back home. But something changed about mid-way through-you lost control.</p>
<p>Before you knew it, the fun and laughter carried you away.</p>
<p>You overdid the drinking part and though you felt that you could safely drive back home, the authorities caught up with you at the intersection just ahead of your house.</p>
<p>Now, you find yourself in the back of a police cruiser, handcuffed and humiliated and wonder &#8220;what&#8217;s next?&#8221;</p>
<p>Well, in case you did not know, the Virginia DWI/DUI laws and associated penalties are tough!      </p>
<p>          ]]&gt;</p>
<p>
The following is a list of what persons charged with a first offense DWI/DUI face:</p>
<p>- Your license is suspended for 1 year from the date of conviction. <br />
- You face up to 00 in fines, plus Court costs. <br />
- You have to pay for, enroll in and successfully complete the Virginia Alcohol Safety Action Program (where you are subject to random drug/alcohol tests and have to pay about 0 for the course). <br />
- If your BAC (Blood Alcohol Concentration) is greater than 0.15 but less than 0.20, it is compulsory for you to serve at least a 5-day jail sentence. <br />
- If your BAC is more that 0.20, then the jail sentence is a minimum of 10 days.</p>
<p>If you this is not your first offense of DWI/DUI, then you face additional penalties such as: &#8211; Potential Class 6 Felony on your permanent record. &#8211; Minimum 20 days of mandatory minimum jail sentence. &#8211; Up to three years of license suspension. &#8211; Permanent loss of your vehicle.</p>
<p>If you are convicted of DWI/DUI while transporting a minor in the car, you could be sentenced with an additional 0 to 00 in fines and a minimum of 5 days in jail.</p>
<p>In addition to all of these items, you have to retain a Virginia DWI lawyer (which will cost another ,000) as well pay for assigned risk automobile insurance (which is extraordinarily expensive)!</p>
<p>Remember-all of these penalties, costs and inconveniences can be avoided by simply taking a cab, having your sober friend drive you home or staying the night at the home of the party host. </p>

Compared to pot, alcohol is really far more powerful on the human mind and body. I have experimented with both for sometime, and I have always has good times while stoned rather than drunk. I have seen a lot of people die from alcohol poisening; but never have I heard of a Marijuana poisening, or &#8220;overdosing.&#8221; I also rarely hear about (and by rarely I mean twice in my life) about a &#8220;stoned driver killing a person while driving under the influence,&#8221; and they were likely just unfortunate accidents that would have likely occured with pot involved or not. </p>
<p>Nonetheless, alcohol is far more addicting and dangerous and I believe that America has the wrong substance extremely available to the public legally. For those about to question  the movie &#8220;REFER MADNESS,&#8221; I assure you people do not behave like that on Marijuana, and I do believe that alcoholics are the ones causing fights, accidents, divorces, and are those more likely to rape someone. And one cannot over dose on weed&#8230;.</p>

<p><strong><i>Question by I&#8217;m gonna start another riot</i>: What do you think Two illegal aliens charged with murder in Virginia Beach (sanctuary city)?</strong><br />
On Saturday night, Virginia Beach police arrested Jorge Alberto Fuertes Loredo, 31, and Isidor Loredo Amaya, 31, after Florentino Martinez-Melendez, 40, was shot to death in a trailer park. A second victim survived the shooting but remains in critical condition in a local hospital.</p>
<p>Apparently, the fatal shooting was the result of a heated argument.</p>
<p>Both Loredo and Amaya have been charged with murder and use of a firearm in the commission of a felony. Both Mexican nationals are in the country illegally, and Immigration and Customs Enforcement have placed a hold on them.</p>
<p>Virginia Beach Commonwealth Attorney, Harvey Bryant, said that the two illegal aliens have been living in the state for quite some time.</p>
<p>Bryant said: &#8220;It appears that Mr. Amaya has been in Virginia for about 10 years, spending his time between Harrisburg, Virginia and here.”</p>
<p>A hearing for the two is scheduled for Feb. 4, 2010.</p>
<p>Both shooting victims were also illegal aliens.</p>
<p>This case demonstrates the ongoing dangers posed by the city’s large illegal immigrant population.</p>
<p>In April 2007, in Virginia Beach, Va., a Mexican national named Alfredo Ramos slammed into the rear of a vehicle in which Allison Kuhnhardt and Tessa Tranchant were stopped while waiting at a traffic light. Ramos, 22 was traveling at a high rate of speed and was drunk at the time (he blew a .14 BAC). The two high school students had to be cut from their crumpled car and both later died after being taken to the hospital. Ramos suffered only a busted lip.</p>
<p>Though an illegal alien, Alfredo Ramos had been living in Virginia Beach for quite a while and worked at local a Mexican restaurant known as Mi Casita. Ramos had been previously convicted of three separate charges of public intoxication, identity theft, and even a DUI, but continued to live in the area. He speaks only Spanish and required an interpreter at all of his court proceedings. </p>
<p>The girls which Ramos killed were ages 16 and 17. Tessa Tranchant&#8217;s brother Dylan had only been home from Iraq for two weeks, when his sister was killed. Dylan was tasked with identifying his little sister&#8217;s body. The case gained national fame thanks to the reporting of Fox News&#8217; Bill O&#8217;Reilly, who helped expose Virginia Beach as a haven for illegal aliens.</p>
<p>O’Reilly placed the spotlight on that city&#8217;s Mayor and Police Chief and characterized the resort town as a place where drunken Mexican invaders are allowed to roam freely. </p>
<p>Immediately after the case was reported on the O’Reilly Factor, Virginia Beach Police Chief Jake Jacocks went on the offensive and claimed that O&#8217;Reilly was wrong in focusing on the fact that Ramos was an illegal alien. He accused the Fox News commentator of turning the girls&#8217; deaths into a &#8220;political issue.&#8221; </p>
<p>However, local ABC affiliate WVEC showed that the police chief was at least culpable in the tragedy when they reported that &#8220;Chief Jacocks says the policy of not reporting illegals until after three DUI charges was his idea. He hoped it would let illegal immigrants feel comfortable if they were involved in an accident.&#8221; </p>
<p>Former Mayor Obendorf told reporters: &#8220;I never want anyone to miss the fact that someone who was drunk caused the death of two innocent young women, and it had nothing to do with nationality or anyone doing anything inappropriate as far as the government is concerned.&#8221;</p>
<p>While the leadership of Virginia Beach has never formally declared the city to be a &#8216;sanctuary&#8217; for illegal aliens, the way the leadership of Chicago or Tucson have done, it is every bit the haven to invaders that those two cities represent. Virginia Beach is dominated by hotels, restaurants, and housing developers, all of which hire tremendous numbers of illegal aliens. </p>
<p>Hotel owners often declare that they could simply not operate without the influx of Mexican and Central American nationals who can frequently be seen passed out drunk on the beach during the summer. The city has also seen thousands of over-priced cookie cutter homes built in the last several years, most of which have been constructed by illegal Mexican labor. </p>

Claudia- I fully support your right to like Lindsay Lohan, I&#8217;m not saying that I think she should go to jail because I hate her. Even Paris, who got only 1 DUI, was sentenced to 40+ days!! Nicole Richie got 1 as well and she goes in tomorrow to do her 4 days.<br />
And Lindsay got sentenced 4 days, but since when she was arrested she spent overnight in jail, which somehow translates into 3 days (don&#8217;t get how that happened) so she gets her 4 days minus the 3.</p>
<p>AND she didn&#8217;t even have to go to court!! Her lawyer showed up, made a plea deal, now all Lindsay has to do is sashay into jail for 1 day and leave. AND I don&#8217;t even want to hear about her and rehab, it seems like it&#8217;s a retreat for her since she&#8217;s been there twice. AND I&#8217;ve seen the tour of her &#8220;rehab&#8221; place. Send me there ANY day. She gets her own chef!!!!!</p>

I was reading something about K-9 searches on a reliable website and it states the following; </p>
<p>7. What if the police call in drug-sniffing dogs?</p>
<p>Your rights do not disappear if the officer threatens to call in the dogs, so don’t let this all-too-common tactic intimidate you into consenting to a search.</p>
<p>Before the dogs arrive, you have the right to dismiss yourself by asking if you are free to go. But if the officer detains you until the dogs come, remain silent and refuse to consent to any searches.</p>
<p>If a K-9 unit arrives, you should never consent to a dog sniff even if the officer claims you have to (which would be a lie). Remember: Unlocking your car at the officer&#8217;s request or handing the officer your keys is the same as consenting to a search.</p>
<p>3rd paragraph what do they mean you should never consent to a dog search?  I thought consent wasn&#8217;t an issue because a dog walk around the car was not invasive and requires no reasonable suspicion.</p>
<p>What does paragraph 3 mean by do not give consent</p>
<p>If you don&#8217;t &#8220;Unlocking your car at the officer&#8217;s request or handing the officer your keys is the same as consenting to a search&#8221;</p>
<p>you haven&#8217;t given consent for a dog search.</p>
<p>Mainly I want to know what paragraph 3 means with regards to the defendants rights, I was not aware consent was an individual right with dog searches.<br />
How would an individual exercise their rights to the fullest according to paragraph 3?</p>

<p><i>Answer by Running Man</i><br/>The dogs are instruments of the police.  Therefore, the dogs acting upon police commands are held to the reasonable suspicion clause.  However, the are always exceptions to the exception in the law.  If reasonable suspicion exists then police officers can have the dogs sniff the outer layer of your clothing.  If the dog then indicates that you are carrying drugs for example then that would lead the officer to believe (probable cause) you do in fact have drugs and he would then be able to conduct a legal search under the 4th amendment.  But you must always remember that there are exceptions to the exception when it comes to law.</p>

I&#8217;m 18, and recovering from a fairly severe bout of anorexia.</p>
<p>I started using drugs on a recreational basis at a young age, just smoking pot and drinking on the weekends. By the time I was in high school i was taking painkillers, molly, anti-depressants and smoking daily. I quit nearly everything during the course of my eating disorder (weed made me hungry, alcohol had too many calories) but I&#8217;ve relapsed with a vengeance during my recovery. I start drinking about two hours after waking up (this was going on during the time I was in school, especially on days that I was required to be in school. I couldn&#8217;t deal with school sober), I smoke continuously all day and I&#8217;ve tripped acid more times than I can recall in the past month. There is a period of about twelve days that I have absolutely no recollection of. Honestly I haven&#8217;t been completely straight for about seven months. I&#8217;m not shooting up heroin or anything but if I continue down this road I&#8217;m sure that it&#8217;s not far off.</p>
<p>I&#8217;ve just recently been convicted of a DUI and I&#8217;ve been charged with unrelated underage drinking.</p>
<p>I think I need to get help before this gets any worse. I&#8217;m looking for a possible outpatient treatment other than AA, etc. I need something for underage users because I&#8217;m not 21, I&#8217;m barely 18</p>
<p>I live in Western NC, the Asheville area</p>
<p>Basically I drink and use drugs because I&#8217;m still not ok with being at an average weight. I&#8217;m not entirely over my eating disorder, when I am sober I&#8217;m constantly thinking about how fat I&#8217;m getting. The drugs &#8220;help&#8221; me deal with my weight gain.</p>
