A Wallin & Klarich client recently was dismissed of all charges after being arrested for drug possession in Ventura following a traffic accident. The client was represented by experienced defense attorney Rastin Ashtiani of Wallin & Klarich.

I always tell my clients that they should always assert their 5th amendment right to remain silent and 4th amendment right against unreasonable search and seizure. Even if they are arrested initially as my client was in this case, you want to make sure you do not provide the government with evidence that can be used to get a conviction, said Mr. Ashtiani. An arrest and subsequent dismissal is always better than a criminal conviction down the line.

According to court record from Ventura County Court, the client was found to be in possession of a controlled substance after he was involved in a traffic accident and law enforcement searched his car. After the officers arrived at the scene of the accident, they mentioned that the smell of marijuana was coming from the clients car. The client then gave the officers consent to look through the vehicle where the officers found not only marijuana, but also cocaine and prescription drugs. The client was then arrested and subsequently charged with possession of a controlled substance under California Health and Safety Code section 11350(a) and California Business and Professions Code section 4060.

After being charged with possession of a controlled substance in Ventura, the client faced three years imprisonment in the county jail and the possibility of both a felony and misdemeanor conviction appearing on his record if the charges were not dismissed, according to court documents. The client sought out the assistance of Mr. Ashtiani, who immediately began to investigate the case and the surrounding circumstances.

In a case where the client is charged with drug possession the prosecution has the burden of proving that the client is guilty. As an experienced defense attorney, Mr. Ashtiani was aware that he did not necessarily have to prove that the client was innocent, but rather needed to show that there was significant doubt that the client was in fact guilty. Mr. Ashtiani successfully raised enough reasonable doubt as to whether the drugs actually belonged to the client, which in the end convinced the district attorney to drop the charges against the client. As a result, the client does not have any criminal convictions on his record and will not serve any jail sentence.

According to court record from Orange County Superior Court Central Justice Center, the client was convicted in 1996 of indecent exposure under California Penal Code section 314.1, a misdemeanor in Orange County. As a result, the client was sentenced to 26 days in the county jail, placed on probation for three years, ordered to pay fines, and was required to register as a sex offender with law enforcement pursuant to California Penal Code 290. Previous to hiring the experienced and knowledgeable sex crime defense attorney, Mr. Klarich, the client faced having to register as a sex offender for the rest of his life.

After the client sought the help of Wallin & Klarich, he was referred to a clinical and forensic psychologist according to Wallin & Klarich. The psychologist evaluated the client and wrote a detailed report that stated the client had been rehabilitated. The report, along with other vital information about the client, was brought together by Mr. Klarich in the form of a petition for a certificate of rehabilitation and filed with the Orange County Superior Court Central Justice Center.

After the petition for a certificate of rehabilitation was filed with the Orange County Superior Court, a hearing took place. At the hearing, several other attorneys and clients were also petitioning the court for a certificate of rehabilitation according to court records. However, at the hearing the client of Wallin & Klarich was the only one granted a certificate of rehabilitation and therefore relieved of the duty to register as a sex offender. The client no longer bears the burden of having to register as a sex offender, which had severely impacted his daily life by preventing him from taking certain employment opportunities and from living in government assisted housing.

To begin with, everyone knows of the potential risks to the drivers and the public in general with Driving While Intoxicated North Carolina. It can be dangerous and downright deadly to those who do not act responsibly and make sure they do not drive while intoxicated on North Carolina roads or highways. This release is not meant to trivialize the risks, but rather to identify with the known consequences of a DWI arrest and conviction as oppose to the hypothetical risks that can occur to the driver and the public in general. That being said, most people are unaware of how easily it is to be charged with a DWI in North Carolina and what consequences the driver will face if convicted; to that extent, we wish to issue a reminder of these facts.

First, in order to be convicted of a DWI in North Carolina, the State only need prove that the Defendant was Driving, on a Street, Highway or Public Vehicular Area, and that the Driver either 1. had a Blood Alcohol Concentration of .08 or more or 2. that the Driver was ‘Appreciably Impaired.’ What this means is, if you are caught behind the wheel of a running vehicle on a street, highway or any public vehicular area (think parking lot) and you end up having a BAC of .08 or more, or the police feel they have enough evidence to prove ‘appreciable impairment’ you can be charged and ultimately convicted.

Many people do not realize how easily a person can reach a Blood Alcohol Concentration of .08. The reality is, everyone’s body is different, and what a ‘few drinks’ can do to one driver can have a different affect on another driver. It is never a good idea to drive after having a ‘few drinks’ even if you feel fine as the test is not whether you feel you can drive, but whether your BAC is .08 or above.

In addition to the BAC part of the North Carolina DWI Law, the ‘appreciable impairment’ part is even trickier. Did you know that people have been convicted of a DWI in Wake County with a BAC of .07 and .06? The reason is they were convicted under the ‘appreciable impairment’ portion of the NC DWI law. While it can be technical and scientific, the best way to describe ‘appreciable impairment’ is it is the Police Officer’s opinion that you were too drunk to drive. Now, the Police will use Standardized Field Sobriety Tests and their training to make this assessment, but the reality is, even if you are below a .08 BAC, or you refuse to give them a breath sample, you can still be convicted.

County Commissioner Traffic Stop Caught On Tape: Lieberman Told Trooper She Had One Drink From WHIO TV: www.whiotv.com DAYTON, Ohio — Montgomery County Commissioner Deborah Lieberman’s traffic stop by the State Highway Patrol Jan.19 was caught on videotape.She was pulled over by a trooper as she traveled on Interstate-70 near Hoke Road just after 3 am The entire traffic stop was recorded on tape from a camera in the trooper’s car. The trooper was wearing a microphone and his conversation with Lieberman can be heard. While still in her car, Lieberman told the trooper she had just one drink. Later, she failed the field sobriety test, was handcuffed and taken to the local post of the highway patrol. While in transit to the post, Lieberman told the trooper: “I’m not driving drunk. I’m a county commissioner.” She was first elected to the Montgomery County Commission in 2004. The trooper at one point thought Lieberman might have tried to turn off the video camera from the back seat of the cruiser, but Lieberman said she had not touched it. “I’m sitting back here with handcuffs on. My God, you know I’m a Montgomery County commissioner, ” Lieberman said. Once at the patrol post, Lieberman registered a .131 percent blood alcohol level. The legal limit is .08 percent. Later in the week, Lieberman appeared in court but was not convicted of a crime. She was allowed to take part in the diversion program, which is open to first-time offenders. Drunk driving defense lawyer Jesse Scharff of Roberts Law Group, PLLC, in Raleigh, obtained the dismissal of a DWI charge after successfully appealing a DWI conviction to the Superior Court. Securing the dismissal meant that the client, who was facing a mandatory minimum of seven days in jail that could extend up to one year, avoided prison time completely.

In North Carolina v. J.O., case number 10CRS059528, the accused drunk driver had been represented by another firm and convicted of driving while impaired at trial in district court. Roberts Law Group, PLLC, was hired to handle her appeal. She already had a prior conviction for DWI on her criminal record and was facing increased penalties for a second offense DWI.

Court documents show that DWI defense lawyer Jesse Scharff was able to successfully challenge the stop that lead to the DWI arrest. Attorney Scharff filed a pretrial motion to dismiss, asserting that the checkpoints were unconstitutional. Upon investigation, Scharff discovered that police had been targeting patrons of a local bar by setting up license checkpoints in the middle of the night; a bar employee who served as a witness confirmed that law enforcement had been targeting the hangout since new owners had taken over.

The Superior Court granted Scharff’s motion to dismiss the DWI charges. The Durham County District Attorneys office appealed the dismissal but withdrew its appeal a year later. Sharff was able to use his knowledge and experience to achieve dismissal of the second DWI conviction and keep the accused impaired driver out of prison.
