Question by Rollin_West: Why do some police officers go to bars and get drunk and drive, but we can’t.?
I swear they go out and get hammered and don’t even think twice. Then the next night they are out stopping people for drunk driving??? This is not a bunch of BS either. There is a bar down the street from my house. It’s a cop bar abd they have their cop loving groupies there too. They get hammered and do shots just like anyone else. Are cops the only ones who can go out and have a good time anymore? Why do they pass out DWI like bubble gum, then turn around and drive drunk themselves??? I mean you already have your stop light cameras and road blocks. When are the police going to start practicing what they preach????
Oh by the way a drunken poplice officer killed a young man in St. Louis County last year in a car accident at 3:00am.
Don’t even try it. If a cop get’s pulled over in his own municipality by one of his “brothers”, then he will not be arrested and you all damn well know it.

Best answer:

Answer by El Scott
I have never drove drunk.

Anyone that does needs to be arrested. I know of several officers that have been arrested and convicted of DWI. I personally arrested a Reserve Officer back in 1992 (or maybe it was 1993) for DWI.

Your question makes it sound like we do this all the time. If an officer makes a bad decision then they will reap what they sow.

What do you think? Answer below!

Conroe, TX (PRWEB) December 12, 2012

Police mistakes, lawyer errors and driver slip-ups can lead to unfair DWI arrests and convictions, attorney Joseph LaBella, a DWI lawyer in Conroe, said today.

When drivers are pulled over on suspicion of driving drunk, many mistaken DWI arrests take place, attorney LaBella explained. He said drivers should be aware that there are steps they can take to help ensure that they are given fair treatment by law enforcement and effective legal representation by a knowledgeable DWI lawyer.

Joseph LaBella, attorney representing clients in the Houston area, said police DWI errors are particularly common, including insufficient cause for stopping a driver, unlawful DWI roadblocks and following a driver into his or her residence without probable cause. Faulty Breathalyzer test results can also lead to illegal DWI arrests, he said. This can occur when a person suspected of driving under the influence may be forced to give breath samples using defective equipment or improper collection procedures that will not be allowed in Court, he explained.

The government must prove that they followed all protocols or the reliability of these tests comes under serious fire, LaBella said.

According to a March 6, 2012 San Francisco Chronicle article, hundreds, if not thousands, of drunk driving convictions in that area could be overturned because, for at least six years, none of the police departments Breathalyzer equipment was properly tested. Police blunders such as this can result in drivers being falsely accused of operating a vehicle under the influence, attorney LaBella said.

Houston area DWI lawyer Joseph LaBella explained the key role that a breath test plays in a DWI arrest. Before a Texas citizen can be convicted of DWI, the driver’s blood alcohol concentration (BAC) must be shown to be .08 or higher at the time of driving, he said. But there are many reasons a Breathalyzer might give a false reading. It could be a malfunctioning Breathalyzer that was not calibrated properly. It may have a defective Intoxilizer or an error rate of .02 allowable between two breath specimens. It is crucial that any driver pulled over for swerving or accused of reckless driving has an experienced DWI attorney who can rule out these possible law-enforcement errors.

Inexperienced DWI attorney blunders can also result in erroneous driving drunk convictions, LaBella warned. A driver wrongly convicted of drunk driving can be jailed, heavily fined, lose a job or have insurance rates go up, all due to an inept DWI lawyer who doesnt know what he or she is doing, he said. An inexperienced DWI lawyer can lose a drunk driving trial for many reasons, he explained. He or she may ignore evidence that breath test rules were not followed and assume a DWI case cant be won, LaBella said. In addition, an attorney may not fight a suspended license, decide not to put the convicted driver on the stand or choose not to consult a DWI specialist when that can make or break a drunk driving case, the attorney said.

LaBella said drivers themselves make errors that can lead to mistaken DWI arrest and conviction as well.

Drivers accused of drinking before getting behind the wheel may not take a DWI arrest seriously and fail to get a seasoned DWI attorney to represent them, LaBella said. They may not insist on an ALR (Administrative License Revocation) hearing or request that the arresting officer is present at it. The Texas Department of Public Safety will, in some cases, revoke a drivers license and, if the driver doesnt appear at the hearing, the Court can issue a bench warrant.

The list of potential DWI case mistakes is long and the entire DWI process is complicated, according to LaBella. Further information about DWI driver, lawyer and police mistakes can be found at http://www.texas-dwi-lawyers.com.
