Question by Dustin A: About a year ago i got something called a baby DUI i was underage and blew a 0.04?
If i would have been 21 at the time i would have been good but i was only 20 so i was charged with this DUI. I live in the state of virginia, what class of misdemeanor is this and how will it affect my future? I no longer drink anymore i learned that its not worth it in the long run.
This is the only trouble i have ever been in.

most likely it is a class b misdemeanor but it won’t affect your future you dont have any felonies do you? those are the ones to look at for

All this is from the out of state info sheets.

What’s in the exam ‘relate to the subject matter in three volumes of the Annotated Code of Maryland’. These subjects are included:

“General Provisions, Civil Procedure in Circuit Court and District Court, Criminal Causes, Evidence, Settlement of Decedents’ Estates, Appellate and Other Judicial Review in Circuit Court, Appellate Review
in the Court of Appeals and Court of Special Appeals, Family Law Actions, Guardians and other Fiduciaries, Juvenile Causes, Property Actions, Receivers and Assignees, Sales of Property, Other Special Proceedings, and Courts, Judges and Attorneys.”

It is important to remember that the exam is open book! You can use the ‘three volumes’ that I talked about earlier.

You will need a ‘character approval’. You must complete your filing. There are a couple of things that need to be attached: remember them!

Question by Lovious: Please provide legal reference about carrying swords in New York.?
I see only laws about concealed swords, or carry with intent to do harm. I could not find reference that a sword, not concealed, nor drawn out of it’s sheath would fall under criminal possession of a weapon. I personally do not intend to carry a sword, but this is in response to a previous question, where I believe the person was given “gut feeling” advice. I would prefer well documented advice.

Like almost every state, New York does not have “explicit” laws regarding swords, due to them being rather out of fashion for almost 200 years.

That being said, the law provides the nebulous ban on “any other dangerous or deadly instrument or weapon with intent to use the same unlawfully against another” (New York – Penal Law Section 265.01, Part (2)). Such statutes are INTENT-based, meaning it takes a judgement call on the part of law enforcement on a case-by-case basis.

For example, you buy a sword at a store, and walk home. If a police officer were to confront you, you can take out your receipt, and can reasonably show that you just bought it 10 minutes ago, the store is one block over there, your house is over here, etc. It’s very unlikely you would be arrested.

I can’t think of too many other reasons that are going to be a convincing reason to carry a live steel sharpened sword in public. Actors and other performers use blunted ones, and even then the individual cities usually require a permit (varies by area) for working out in public. “Self-defense” typically doesn’t fly with cops, given how weird a choice of armament it is.

It’s going to come down to what your doing, why you have the sword, and what evidence is around you.

CHICAGO, Aug. 25 (UPI) — Jurors acquitted a woman who used her BlackBerry to record two Chicago police officers secretly, with one saying jurors saw the charges as “a waste of time.”

Tiawanda Moore, 20, could have received a 15-year prison sentence if convicted, the Chicago Tribune reported. Under Illinois law, audio recordings are illegal unless everyone involved has consented, and penalties are especially severe if law enforcement officers are involved.

Moore acknowledged making the recording. She said she believed the Internal Affairs officers were trying to convince her to drop a harassment complaint against an officer she said f ondled her when he responded to a domestic violence call, the Chicago Sun-Times said.

The jury heard the recording in court.

“The two cops came across as intimidating and insensitive,” Ray Adams, 57, a pharmacist, told the Tribune. “Everybody thought it was just a waste of time and that she never should have been charged.”

The American Civil Liberties Union is challenging the Illinois law in federal court.

Brad Williams has filed a lawsuit against the Chicago police department after he said he was beaten by police in response to his filming an officer holding and dragging a man outside of his squad car.

As we have seen in other cases, one of the officers falsely told Williams that citizens were not allowed to film police officers in public, according to the complaint.

He said that he was handcuffed and grabbed by the throat in the encounter. His mother was injured after she says that an officer caused her to stumble to the ground.

The eight-count suit claims excessive force, false arrest and imprisonment.

The United States Court of Appeals for the First Circuit became the latest court in a recent decision to rule that police efforts to bar such videotaping is a violation of the First Amendment. That case involved Boston attorney Simon Glik, who was arrested for recording another arrest in public. We discussed the case earlier.

These cases continue to occur because officers are not disciplined for such abuses. Most such threats probably succeed and other cases are simply dropped with no action taken against officers. In the meantime, city council members and state legislators have done little to protect the public from such violations.
