UCLA Professor of Public Affairs Mark Kleiman is “angry about having too much crime and an intolerable number of people behind bars.” The United States is home to five percent of the world’s population and 25 percent of the world’s prisoners, yet, says Kleiman, our high incarceration rate isn’t making us safer. In his book, “When Brute Force Fails,” Kleiman explains that, when it comes to punishment, there is a trade-off between severity and swiftness. For too long the US has erred heavily on the side of severity, but if we concentrate enforcement and provide immediate consequences for law-breakers, Kleiman says we can both reduce the crime rate and put fewer people in prison.     The guy seems to have a few good points but goes off on tangents and misses the two biggest problems: criminals are made, not born and the prison system is trying to lock up poor people.

    Most repeat violent offenders are the victims of severe abuse and can be rehabilitated given the right programs and the prison system is more concerned with locking up the poor then anyone else.

    The thing you get wrong here is this: According to the Law, when a person commits a crime, it is behaving wrongly against the State itself. There’s not really a “private” victim, the victim will always be the State. That’s why prosecutors will go ahead with the prosecution even after the charges are dropped by the victim. That’s also why we have such things as “Miranda vs Arizona”.

    I think that it wouldn’t be a bad idea to use public flogging as punishment for certain crimes rather than long prison sentences. Not only would it adequately punish the criminal, it would make an example of him for other potential criminals as well as free up prisons to hold the more dangerous criminals.

    For example, the industrial area that I live near. Some assholes used to dump their industrial waste onto their own properties 30-40 years ago before Environmental Protection Laws. Today it is seeping into nearby areas.

    At the time, this was a “victimless” crime.

    BTW, there is no such thing as “natural” rights. It is a man made concept.

    The US needs more non-custodial rehabilitative sentencing options, where people perform community work and undergo assessment and treatment for the issues that are causing them to offend. Works very well here in Australia.

    Professor Kleiman, what you say in this video is very reasonable.  The next part of the public policy / civics lesson–and perhaps you have included this in your book–is what the average citizen can do to move our criminal justice system in the direction you are advocating. And, of course, we have the federal justice system, the state prison systems, and local county and city jails to deal with.

    Education on this issue is paramount. Thank you, professor, for your contribution.
