arrest for DUI, but not booked; was this a “sloppy” arrest?

Question by andy : arrest for DUI, but not booked; was this a “sloppy” arrest? I have a friend who i heard got arrested for a DUI. Hes 17 years old, and at the time of arrest, he was not read his rights. When he was taken to the station, he didnt get booked or fingerprinted. Also, he was breathalized; however, the arresting officer did not right down his BAC nor did he recieve a court date. His license was taken from him and returned to the DMV, sating that it was suspended for a year, but with all of these “errors” does that mean that his license can be retrieved? After reaching this news, i was a bit astaunished and had to ask: did the officer let him off easy? Best answer:

Yes the officer let him off easy. Hes 17, so underage for legal drinking, plus DUI, and he wasnt arrested? I think that is what you said. I didnt understand. But since he was 17, underage, and DUI he should have spent overnight and got a a court date and maybe lost his licence for life. I wouldnt take it to court. If they did make a police report, you would have to PROVE he wasnt read his rights. Also, if he was arrested before, they wouldnt have done his fingerprints. They would already be in the records.

    There are no errors. The machine has a print out, no need to write it down right away.

    If he was taken down to the station he was arrested.

    It is not a requirement that an officer read you your rights when you are arrested unless the officer is going to ask you question about the alleged crime after you are in custody. Even if the officer fails to do so the only thing that will happen is the answers you provided can be excluded as evidence in court. This does not include identifying information.

    He will receive a court date later, they do not do that at the time for criminal charges, only for traffic tickets. DUI is a criminal charge
