Fort Lauderdale Slip and Fall Lawyers at Bernstein & Maryanoff Settle Personal Injury Lawsuit

Specifically, the lawsuit was filed in the Circuit Court of the 17th Judicial Circuit in and for Broward County, Florida. The case was assigned a case number of CACE 06 007060(21) and it concerned an allegation that the plaintiff, an individual female, was injured because of the negligence of the defendant, a local corporation that involved the failure of that defendant to keep and maintain a safe premises for foreseeable visitors. The case sought several different forms of damages that were allegedly incurred by the plaintiff.

According to the documents that were filed in conjunction with the case, the plaintiff was lawfully on the premises of the defendant within the boundaries of Broward County when the incident at issue occurred. As she walked across the defendants parking lot, she allegedly slipped and fell on a patch of oil that had gathered on the concrete. The plaintiff was badly injured as a result of this slip and fall accident, suffering severe harm to her back. These injuries required immediate medical intervention as well as ongoing medical oversight and treatment.

The court documents went on to state that: (1) the defendant had a duty to maintain a safe parking lot for invitees; (2) the defendant either knew or should have known about the dangerous condition that was the oil in the parking lot; (3) the defendant failed to take steps to either remove that dangerous condition or to clearly warn foreseeable entrants onto its property of its presence; and (5) this alleged negligence caused the injuries suffered by the plaintiff.

Rather than fully litigate the matter, the parties to the lawsuit were able to come together and negotiate a settlement. The two sides also executed a confidentiality agreement, meaning that the details of this settlement are to be kept private. The case is now considered closed by both sides. What’s in the exam ‘relate[s] to the subject matter in three volumes of the Annotated Code of Maryland’. These subjects are included:

“General Provisions, Civil Procedure in Circuit Court and District Court, Criminal Causes, Evidence, Settlement of Decedents’ Estates, Appellate and Other Judicial Review in Circuit Court, Appellate Review
in the Court of Appeals and Court of Special Appeals, Family Law Actions, Guardians and other Fiduciaries, Juvenile Causes, Property Actions, Receivers and Assignees, Sales of Property, Other Special Proceedings, and Courts, Judges and Attorneys.”

It is important to remember that the exam is open book! You can use the ‘three volumes’ that I talked about earlier.

Florida Injury Lawyers at Bernstein & Maryanoff Settle Lawsuit Arising from Car Accident

According to the court documents, the plaintiff, an individual male, was driving his vehicle in Miami-Dade County when he encountered a location where other drivers needed to provide him with the right-of-way. However, the court documents stated that the defendant, also an individual male, allegedly failed to yield the right-of-way that was owed to the plaintiff. As a result of this alleged failure, the two vehicles collided.

The court documents went on to state that the plaintiff suffered serious injuries to his shoulder, his leg and his back as a result of the accident and that each of these injuries required extensive medical care that included protocols of medication and ongoing rehabilitation. The plaintiff suffered financial losses that included medical costs and lost income as well as property damage. He also suffered non-financial losses that included pain and suffering. He sought to recover those losses with this lawsuit.

Rather than fully litigate the matter, the Florida injury lawyers at Bernstein & Maryanoff were able to come together and successfully negotiate a settlement. The two sides also executed a confidentiality agreement, which means that the specific terms of the settlement cannot be disclosed. The lawsuit was subsequently dismissed and the matter is now considered closed.

San Diego Bankruptcy Lawyers at the Golden State Law Group Respond to Student Loan Survey

The San Diego bankruptcy attorneys at the Golden State Law Group represent consumers and businesses that have encountered serious financial difficulties. The firm helps clients navigate their way through bankruptcy cases filed under Chapters 7, 11 and 13 of the United States bankruptcy code as well as helping clients deal with tax debt problems. The attorneys at the firm would like to respond to the results of a survey conducted by the Credit Union National Association, or CUNA, regarding the level of knowledge possessed by high school students regarding student loans.

The CUNA survey at issue is known as the first annual High School Student Borrowing Survey, and in the survey the researchers asked 847 students who are 17 and 18 years old and who are currently still in high school and considering continuing their education into college about student loans. There were several results that were measured, and all of them indicated that people in this position tend to lack knowledge regarding the realities of borrowing to fund higher education.

For instance, the results of the survey revealed that half of all of the respondents did not know how much they would owe after they completed their education, despite the fact that only 20 percent of the respondents stated that their parents would pay these costs for them. In addition, 83 percent of the respondents did not know what interest rate they would pay for these student loans nor did they have an understanding of how long it would take to pay off these balances.

Approximately 60 percent of the respondents stated that they did not know if they would need to take out one or multiple student loans to pay for their educations, but 80 percent indicated that they considered borrowing to pay for higher education a normal step for someone to take. The researchers went on to point out that the class of 2011 graduated owing an average of $ 26,600 in student loan debt.

The San Diego bankruptcy lawyers at the Golden State Law Group find the results of this survey troubling, as it indicates that not enough people who are going to take out student loans are aware of the true nature of these obligations. Student loan debt is generally not a type of debt that can be discharged in a bankruptcy case in the absence of relatively rare circumstances.
