Question by : is it illegal for a divorce lawyer to issue two different sets of papers? My set of papers have a set time and to keep down drama from the ex, I just go along with whatever she says (which is always different). Asking her a question is like having sand in the wrong place (pain in the *%#. Instead of answering a question that is about the children, she’s got to get ugly with something like “if you don’t have papers, go see your lawyer”. Paperwork isn’t the problem, her papers are totally different and my “lawyer” isn’t returning calls regarding this matter. My ex isn’t the easiest person to get along with because it’s always her way, but I’m a little tired of looking at my paperwork then going along with whatever she says. Your paying a lawyer to do this, let him deal with it. When her lawyer gives it to him you will see it. Your lawyer will make changes and send it back. after about three times, you go to see a Judge and let him or her settle it.

Your Final Resolution is only ONE set of paperwork. You each got a copy. There can’t be two different ones floating around. Both of you had to sign the damn thing. I suggest you find yours or get a new copy from your attorney. Then commit every word to memory. Like I tell my clients,consider those papers the “Rule book” for dealing with your ex from now on. If it’s in there,do it. If it’s not,then it’s up to you what to do.
One of you has to be using an early draft of the final resolution. There were changes made in or just before court and one of you never realized the mistake. You don’t need to talk to your attorney for this,anyone in the office can merely get your case file and check to see if you have the last set of papers issued. Might brighten your day to find out you’ve been using the right papers all along and your ex hasn’t. Not the first time that’s happened,believe me.
Is it “illegal” for an attorney to issue two sets of papers? No. It’s impossible. Go to the Clerk of the Court office and ask to see the file on your divorce. See those papers in there? Those are the ones you go by. That’s it.
If your divorce is final, there can only be one set of paperwork. You can get a copy at the courthouse, but in my state they charge you a fee to look it up, unless you know the case number. You can look at the document at the court house for free but they charge you by the page to make copies.
