Question by li1man94 : Cop’s cant do this? need help? I got pulled and the cop took some weed from my car and blah blah blah( a few threats to jail later) he lets me go as long as my mom gets me. While im leaving he says “im not letting you drive for 30 days or im going to arrest you for DUI”. They never charged me with anything there so how can they hold that above my head?I dont think they are able to do this but i need advice from someone knowledgeable in law. Please no comments about how i shouldnt be in this situation i need help thanks.
Also im not going to type to whole story because i was talking to them for 2 hours but they let me go home with my mom and issued nothing i think they were trying to scare me but i need to drive to go to school and work. Best answer:

As long as he said that while you were still detained and he has the evidence(the weed) he can arrest you for that but I’m pretty sure you wouldn’t be driving for 30 days anyways if you were arrested but to answer your initial question he can technically arrest you unless you already left the scene before he arrests you. If he never issued you a written statement stating that you can not drive for 30 days I would just keep on driving…
The police are crooked you should know that. He has a badge, there for he can do whatever the hell he wants.
You do realise the cops are trying to cut you some slack — they acutally could have charge you with something but they cant be fucked doing the paperwork.

That cop must have something in mind and that’s why he didn’t bother to arrest you on the spot. Remember that he will always have something against you whenever he wants to. However, if the issue arises then you also have something against him because he did caught you with illegal drug and yet let you leave the scene. If ever he’ll make something worst for you, then consult a good lawyer. I’m sure you and your lawyer could beat that officer.
