A Wallin & Klarich client recently was able to avoid jail time and drivers license suspension after being charged with driving under the influence (DUI) in Old Town Temecula. The client was represented by experienced DUI defense attorney, Andrei F. Lapine, who assisted the client to hire an expert witness to testify that the client did not have a blood alcohol concentration over the legal limit. As a result of Mr. Lapines assistance, the client was able to maintain his job which he has had for over 15 years and avoid serving a lengthy jail sentence.

The client was extremely concerned about the prospect of losing his job if his drivers license was suspended. Thankfully we were able to craft a defense that led to us winning the DMV hearing and having the DUI charges reduced, said Mr. Lapine. The client completely avoided a suspension of his license and he was able to keep his job that he has had for over 15 years.

According to court record from Riverside Superior Court, the client was arrested for driving under the influence shortly after leaving a bar in Old Town Temecula. After his arrest, the client took two breath tests, which both registered at a .10 blood alcohol concentration. The client was charged with two DUI misdemeanors under California Vehicle Code section 23152, and faced the possibility of up to six months imprisonment in the county jail if convicted. The client also faced a separate six month drivers license suspension from the Department of Motor Vehicles (DMV) if convicted.

The client sought out the assistance of Mr. Lapine to help him fight against the DUI charges and avoid the severe consequences that would result from a conviction. The client expressed concern that a license suspension would cause him to lose his job of 15 years according to court documents. Keeping the clients concerns in mind, Mr. Lapine carefully reviewed the facts of the case and found that expert testimony would provide a strong defense to the charges. Mr. Lapine assisted the client to hire a forensic alcohol expert to examine the circumstances of the case. After reviewing the circumstances of the case, the expert concluded that the clients blood alcohol content was below the legal limit of .08 when he was driving, but had risen to .10 after he was stopped by the police.

At the DMV hearing the expert offered his testimony that the client had blood alcohol content under .08 at the time he was operating the vehicle according to court record. The experts testimony helped the client win the DMV hearing and maintain his driving privileges. In addition, Mr. Lapine was able to convince the District Attorney to reduce the charges to reckless driving, a lesser offense, after presenting the District Attorney with evidence of the experts testimony. As a result, the client never had his license suspended and was able to avoid spending six months in jail. Ultimately, the client was able to keep his job and move on with his life past the DUI charges.

According to court record from Orange County Superior Court Lamoreaux Justice Center, the client and her former spouse separated in 2011. After the clients former spouse had proven to be unwilling to discuss settlement terms, Ms. Ochoa went to the court and requested a Mandatory Settlement Conference. She also filed a Request for Order for child support to ensure that the clients financial needs would be met if no settlement was reached.

On the day of the hearing for the Request for Order for child support, Ms. Ochoa was able to negotiate with the clients former spouse regarding divorce settlement terms. The clients former spouse represented himself in the court proceedings and was a Spanish speaker, but Ms. Ochoa was able to successfully communicate with him due to her Spanish fluency. Ms. Ochoa talked with the clients former spouse and resolved each divorce term that was at issue. As a result, the Mandatory Settlement Conference was moved up. Three weeks later a formal judgment was entered and both the client and her former spouse were restored to single persons. The client not only gained the result she was looking for, but the divorce proceedings moved even quicker than expected due to Ms. Ochoas ability to speak Spanish and clearly communicate with both parties.

The California Penal Code allows for a civil compromise in a criminal proceeding. The person injured must appear before the court, in person or by written declaration, where the criminal case is pending and acknowledge that he or she has received full compensation for the loss or injury. According to court record from Los Angeles Superior Court – Metropolitan Courthouse, the client was accused of striking a parked car with his vehicle and then leaving the scene of the accident without leaving a note or any information that would identify him as the driver that hit the parked car. The client was charged under California Vehicle Code section 20002 which explains that any driver who hits another car must locate and notify the owner of the vehicle of the damage, or leave some sort of written notice of the damage in a visible place. The client faced up to six months in jail, up to $ 1000 fine, or both jail time and a fine if convicted, in addition to a three year probation period.

After learning the circumstances of the case, Mr. Ashtiani started negotiations with the owner of the vehicle that the client had hit. After talking to the owner of the vehicle that was struck by the client, Mr. Ashtiani was able to work out a civil compromise according to court documents. The compromise required the client to compensate the vehicle driver for any damage that he had caused. After reaching an agreement, the owner of the vehicle signed an acknowledgement of the civil compromise, which the court later accepted. As a result, the charges against the client were completely dropped. The client not only no longer faces the threat of jail time or hefty fines, but also does not have a criminal conviction on his record.

Cohn, recently represented his client, a former marine, against charges of Attempted 1st Degree Murder (Penal Code 664-187), Attempted 2nd Degree Murder (Penal Code 664-187), Sexual Penetration by Foreign Object w Force/Violence (Penal Code 289(a)(1)), Attempted Sexual Penetration by Foreign Object w Force/Violence (Penal Code 664-289(a)(1)), Criminal Threats (Penal Code 422), False Imprisonment (Penal Code 236) and GBI (Penal Code 12022.7). According to San Bernardino County Superior Court record, the prosecutor utilized the shock value and emotional impact of the photos, the sex toys, the victims emotional statements at the scene, and the neighbors emotional 911 call and testimony. Mr. Cohn argued that this was a case of mutual, intoxicated, consensual sex between his client and the victim, which led to a later argument over magazine sales, the physical assault suffered by his client during a struggle between his client and the victim. Mr. Cohn argued that this was a case of Attempted Voluntary Manslaughter due to a sudden quarrel and heat of passion, in which his client was provoked by the victim and thereafter acted rashly under intense violent emotion without reasoning or judgment. Mr. Cohn argued that the scene and evidence corroborated that theory if the jurors could look past the emotion impact of the initial scene and bloody photos.

The jury deliberated for 2 days and found the former marine guilty of Attempted Voluntary Manslaughter with GBI (great bodily injury) and False imprisonment. As a result, Mr. Cohns client is now facing 5-9yrs in prison and avoids sex offender registration.

Los Angeles Attorney Bob Wilson of the law firm Hutton & Wilson has been a criminal defense attorney and certified criminal defense specialist in California for decades. After defending the rights of thousands of people in the most serious DUI cases throughout Southern California, Wilson is particularly suited to critique the latest developments related to DUI law in California. In short, Wilson believes that AB 2020 is just the latest example of the state trying to deny rights that are guaranteed by the United States Constitution.

Last year, Sacramento proposed and Governor Brown approved AB 2020. The law went into effect in January of this year. Its impact may be difficult to determine since it has only been in place for three months. But the changes it brings may be significant. Before this law was enacted, a person who was arrested for suspicion of driving under the influence of drugs or the combined influence of drugs and alcohol had a choice of whether to have drug levels tested by blood or urine. With AB 2020, the legislature sought to remove the option. Sacramento has now mandated the far more invasive test to determine the presence of drugs in the DUI suspect’s bloodstream.

The summary of the bill states “The purpose of this bill is to remove the option of providing urine samples, and mandate blood tests, for determining the level of drug intoxication when a person is accused of driving under the influence of drugs” (AB2020). Though the bill has become law, it has met some opposition and continues to be assailed by critics. After years of allowing a blood or urine test, some critics ask, why has the state deemed the old system inadequate?

9th District representative Richard Pan, who is also one of the bill’s authors, says “by ensuring that prosecution is based on more accurate test results, AB 2020 increases fairness and efficiency in our criminal justice system (California State Assembly Democratic Caucus). The urine test, some claim, is less reliable than the blood test for drug test. In 1998, the urine test was removed as an option for drivers suspected of being drunk behind the wheel. But suspected drunk drivers still have breath or blood tests as an option. Drivers suspected of drug intoxication have had their options revoked.

Bob Wilson says, “the state is trying to tie the hands of attorneys who believe all suspects have constitutional rights that must be defended. By insisting on a blood test, this further erodes constitutional protections. Searching the inside of someone’s body requires special justification.”

Wilson’s sentiment is similar to the position of at least two organizations that oppose the law and that formally opposed the bill when it was introduced: the California Public Defenders Association and the California Attorneys for Criminal Justice. Bob Wilson and Richard Hutton both serve on the Board of Governors for the California Attorneys for Criminal Justice.

The California Public Defenders Association is on record as saying “this is unnecessary because both scientific literature and several published court decisions have repeatedly and uniformly held that properly conducted and timely urine tests can produce forensically reliable measurement of virtually all drugs in a test subjects system” (Bill Analysis). Unlike alcohol, urine tests for drugs are highly accurate, they contend. The critics of AB 2020 also argue that blood tests expose the suspect to many unnecessary medical risks.

“Regardless of what prosecutors, legislators and law enforcement officers may believe, the blood test is no more reliable than the urine test when it comes to drug testing. At Hutton & Wilson, we typically have our clients’ blood samples independently analyzed and evaluated by top research labs. We did this before AB 2020 and we will continue to do so. We will also continue to aggressively defend our clients’ rights,” Wilson continues. “It’s just a shame that so many more citizens will be subjected to an unnecessary invasion of their dignity through an unneeded blood test. Legislators may believe they are making conviction easier but they are simply creating unnecessary pain and risk for no logical reason.”

Despite Wilsons and other defense attorneys’ protestations, the law is in place. For clients turning to Hutton & Wilson, the law may have little impact since these attorneys are so deeply experienced and have seen countless changes to the law over many years. “The changes we have seen have had no effect on the quality of representation our clients receive. AB 2020 won’t either,” Wilson states reassuringly. But what about people arrested who do not reach out to experienced defense attorneys like Hutton & Wilson? Their fate may be more difficult to predict.

Recently, a Wallin & Klarich client gained a final judgment on her divorce and was able to avoid a default judgment in favor of her former spouse. The experienced San Bernardino family law attorney, Hong Lyu, assisted the client to proceed quickly through the divorce and reach an agreement with her former spouse relating to the distribution of marital property.

When a client comes to me for a divorce matter, I do what I can to ensure that their interests are well represented. Even for relatively simple divorce proceedings, I seek to ensure that my client is adequately guarded, said Mr. Lyu.

According to San Bernardino Superior Court record, the client and her former spouse were married for 9 years. The clients former spouse had initiated the divorce proceedings and given notice to the client. The former couple had no children but did have a home with equity and other property assets that had been acquired during the marriage. A final San Bernardino divorce judgment was needed in order to separate the property equally between the two parties.

Before the client sought the assistance of Mr. Lyu of Wallin & Klarich, the client had not responded to her former spouses petition for dissolution of marriage as stated by Wallin & Klarich. If the client had not responded to the initial divorce pleadings the court would have granted the clients former spouse a default judgment. The default judgment would have included terms that were more favorable to the clients former spouse and the client would have been deprived of certain property rights related to assets acquired during the marriage and would have had no input in the terms of the divorce.

San Bernardino divorce lawyer Hong Lyu prepared and filed a timely response to the initial divorce petition to help the client avoid a default judgment. Mr. Lyu then facilitated an agreement between the client and her former spouse about how the property and debts were to be divided. After Mr. Lyu drafted an agreement, both the client and her former spouse signed the agreement. The court signed off on the agreement and issued a formal judgment, and as a result, the marriage was dissolved.

With the help of Mr. Lyu, the client not only avoided a dissolution proceeding that was not in her favor, but was able to reach a peaceful agreement with her former spouse. This resulted in the divorce proceeding going smoothly and quickly for the client.
