Florida Governor Rick Scott signed bill SB52 into law on May 28, 2013 and it finally kicks into gear on October 1st. The bill bans texting to communicate with others using email or traditional phone texting capabilities. Drivers will still be able to text if it is to report a crime, listen to music or use a text to talk device.

Many doubters say the bill doesnt have much teeth and may go largely ignored by the texting public. Most critics are disappointed that it is being treated as a secondary offense, meaning a police officer can only deal with the issue once they have observed other law breaking behaviors. Consequently, police really dont have much faith that any serious enforcement can be done with the ban as it is presently.

Its a step in the right direction, but it is a small step, says Brad Sinclair of Sinclair Law. Being a secondary offense, the law takes a backseat, priority wise, because its not something that is easily enforceable. You are going to have to see some other violation first. It takes a little bite out of how serious of a stand the state is taking on it.

There are plans to introduce a bill in the 2014 legislative session that will make texting and driving a primary offense. That will give it the necessary teeth to be very enforceable in every Florida jurisdiction. In the meantime, bill SB52 may hopefully be a first step into encouraging folks to stop texting and driving, says Sinclair. Most drivers that admit to driving and texting say that its out of habit more than anything else.
